Welcome to X-Tract, a service published by X-Fabric SAS (hereinafter the “Publisher,” “we,” or “X-Tract”). These Terms of Use (hereinafter the “Terms”) govern access to and use of the platform https://app.x-tract.fr and the associated services.
By accessing or using our services, you accept these Terms without reservation. If you disagree with any part of them, you must immediately stop using the service.

1. Purpose of the Service

X-Tract is a tool that allows a user (hereinafter the “Operator”) to send a location request by SMS to a third party (hereinafter the “Participant”), so that the Participant can voluntarily share their real-time geographic location without installing a mobile application.
The service is primarily used in event management, safety/security, field operations, or urgent interventions.

2. Access to the Service

Access to X-Tract is via the secure interface available at https://app.x-tract.fr.
Registration is required to use the service’s features. Sign-up is done via a phone number, with a one-time code sent by SMS for authentication.
On first login, certain information is requested to better understand the intended use:

  • First name,
  • User status (participant or organizer),
  • Number of events organized or attended per year,
  • Contextual information (volume of participants, location-related history, etc.).
    This data enables X-Tract to tailor the service to the use case, strengthen security, and improve the overall user experience.

3. Operation and Consent

The service relies on sending an SMS containing a unique link to a consent page. The Participant may accept or refuse to share their location. The service operates only with explicit consent.
X-Tract never geolocates anyone without their voluntary agreement. The location link is temporary and secure.

4. User Obligations

The Operator undertakes to:

  • Use the service only in legal, legitimate contexts that respect privacy;
  • Not send abusive, repeated, or unsolicited requests;
  • Respect the rights of contacted persons.
    Any fraudulent or unlawful use will result in immediate account suspension and may lead to legal action.

5. Data Collected and Privacy Protection

X-Tract collects and processes certain personal data to ensure proper functioning of the service, traceability, and compliance with legal requirements.

Data collected:

  • User identity (first name, status, usage information);
  • Phone numbers (Operator and Participant);
  • Location data (GPS coordinates);
  • Technical data (dates, times, IP address, browser, request statuses, Participant response).

Purposes:

  • Enable the sending of location requests and the display of positions on the map;
  • Ensure traceability in case of dispute or investigation (e.g., complaint, security incident, or official request);
  • Produce anonymized statistical analyses, notably on:
    • average response times,
    • location accuracy,
    • consent rates,
    • actual service usage by profile.

Retention period:
Personally identifiable data is retained for a maximum of 2 years to ensure traceability.
After this period, it may either be:

  • anonymized for statistical and service-improvement purposes, or
  • deleted, if required by the user or by law.

Security & confidentiality:
Data is hosted in Europe on secure, HDS-certified servers. Access is restricted to authorized personnel and is subject to regular controls. No data is sold or transferred to third parties.

Data subject rights:
In accordance with the GDPR, you have the right to access, rectify, object, delete, or restrict processing. To exercise these rights, contact: contact@x-tract.fr.

6. Liability

X-Tract makes every effort to provide a reliable, accurate, and secure service. However, the service is provided “as is,” without any guarantee of permanent availability.
The Publisher cannot be held liable for:

  • any mistyped phone number by the Operator;
  • the Participant’s refusal to share their location;
  • abusive use of the service by a third party;
  • technical limitations related to the mobile network, the Participant’s device, or Internet access conditions.
    In the event of a technical anomaly or security incident, we commit to informing affected users as soon as possible.

Incident of 18 June 2025: a malfunction led to unsolicited SMS being sent to certain contacts from archived requests. No personal data was exposed. Fixes were immediately applied and an information notice was sent to users.

7. Intellectual Property

All elements on the site (texts, trademarks, logos, interface, source code, images, etc.) are the exclusive property of X-Tract or its partners and are protected by applicable laws. Any unauthorized reproduction, representation, or use is strictly prohibited.

8. Changes to the Terms

X-Tract reserves the right to modify these Terms at any time. In the event of a material change, a notice will be displayed on the site or sent by email to registered users.
Continued use of the service after changes constitutes acceptance of the new Terms.

9. Suspension or Termination

We reserve the right to suspend or terminate access to the service, without notice, in the event of a breach of these Terms, abusive behavior, or a legal request.

10. Governing Law and Disputes

These Terms are governed by French law. In case of a dispute, amicable resolution will be sought first. Failing that, the competent courts will be those of the jurisdiction of [registered office city].
